What is a Bad Checks Offense in MD?

To pass or write a bad checks is simply to knowingly attempt to purchase goods or services by falsely representing payment in the form of a check.

Under Maryland law, it is easy to charge someone with writing bad checks. There is a simple bad checks form on the Maryland District Court website.

Because it is so simple to do, many people who believe they have a claim file charges before trying less extreme methods to get their money. So there are often a lot of cases in court that really shouldn't be there. We will fight to remove your case from the Maryland criminal court system.

Maryland Bad Checks Laws - Penalties

If you are charged with writing a bad check in exchange for goods, property or services, the maximum penalty depends on the value of the items or services involved (similar to a theft charge).

If the check was for under $300, the maximum penalty is 18 months in jail. This is a misdemeanor level charge.

If the check was for $300 or more, the maximum penalty is 15 years in jail. This is a felony level charge.

You can also be penalized with fines, restitution, probation, community service, and other court imposed sentences.

For most first offense charges of under $300, your risk of jail time is minimal, but a bad checks charge can be serious, and requires an aggressive defense to avoid the harshest penalties.
